NATIONALITY LAW
BRITISH NATIONALITY APPLICATIONS
Clear advice for the final step from immigration status to British citizenship.
OVERVIEW
British nationality applications allow eligible adults and children to become British citizens. For many people, this provides long-term security, the ability to apply for a British passport and full participation in civic life.
Adult applications are usually made by naturalisation. Children usually apply by registration. The rules are different and the correct route depends on the applicant’s age, birth, residence history and family circumstances.
ADULT NATURALISATION
Adults generally apply after obtaining indefinite leave to remain or settled status. The application requires careful review of residence, absences, immigration history, English language, Life in the UK and good character.
Applicant must usually be aged 18 or over.
Most applicants must hold ILR or settled status.
Residence requirement is usually five years, or three years where married to a British citizen.
Good character, English language and Life in the UK requirements normally apply.
CHILDREN’S REGISTRATION
Children’s applications are not the same as adult naturalisation. Some children have an entitlement to register, while others rely on Home Office discretion.
Children born in the UK whose parent later becomes settled or British.
Children who have lived in the UK for the first 10 years of their life.
Children whose parent becomes British.
Children adopted by British citizens or with other qualifying circumstances.
GOOD CHARACTER & RESIDENCE
Good character issues can include criminal convictions, immigration breaches, deception, unpaid taxes or other conduct concerns. Residence issues usually involve absences from the UK and whether the applicant was physically present in the UK at the required point in the qualifying period.
Review absences before applying.
Check immigration history and any gaps in lawful status.
Consider tax, criminal or civil issues before submission.
Prepare explanations and evidence where discretion may be needed.
HOW WE CAN HELP

Check residence and absence calculations.
Review good character and immigration history risks.
Prepare the application, document schedule and supporting representations.
CITIZENSHIP CEREMONY & PASSPORT
Adults whose applications are approved normally attend a citizenship ceremony and make an oath or affirmation. After receiving the certificate of British citizenship, they can apply for a British passport. Children under 18 are usually not required to attend a ceremony, although they may do so voluntarily.
